Please read these Terms of Service ("Terms") carefully before using Contactd ("the Service", "Platform"). By registering an account or otherwise accessing the Service, you ("User", "you") agree to be bound by these Terms. If you do not agree, do not use the Service.
Contactd is a cloud-based messaging outreach platform that enables Users to send messages via their own personal Telegram and WhatsApp accounts. The Service provides campaign management, contact list management, message scheduling, and analytics tools. Contactd does not itself send messages — it orchestrates sending through accounts that belong to and are controlled by the User.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By using the Service, you represent and warrant that you meet these requirements.
To use the Service, you must create an account with a valid email address and password. You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information. The Service operator reserves the right to suspend or terminate accounts that contain false or misleading information.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, regulations, and third-party platform terms (including Telegram's and WhatsApp's Terms of Service). Specifically, you shall not use the Service to:
You represent and warrant that you have a legitimate basis and, where required, prior consent to contact each recipient in your contact lists. You are solely responsible for ensuring that your messaging activity complies with all applicable data protection, anti-spam, and electronic communication laws in the jurisdictions of both you and your recipients.
You connect your own Telegram and/or WhatsApp accounts to the Service. You acknowledge that:
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, the Service operator expressly disclaims all warranties, including but not limited to:
The Service operator does not guarantee message delivery, account safety, or any specific outcome from the use of the Platform.
To the maximum extent permitted by applicable law, the Service operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
In no event shall the Service operator's total aggregate liability exceed the amount you paid for the Service in the three (3) months preceding the event giving rise to the claim. If you have not made any payments, the maximum liability shall be fifty US dollars (USD 50).
You agree to indemnify, defend, and hold harmless the Service operator from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party platform's terms of service; (e) any claims made by recipients of your messages or any other third party.
Access to the Service is granted via API keys provided by the Service operator. The Service operator reserves the right to revoke, suspend, or modify access keys at any time, with or without cause. If the Service is offered on a paid subscription basis, fees are billed in advance and are non-refundable except as required by applicable law.
You retain ownership of all data you upload or input into the Service (contact lists, message templates, campaign configurations). The Service operator does not claim ownership of your data. However, you grant the Service operator a limited license to process your data solely for the purpose of providing the Service. Upon account deletion, your data will be permanently removed in accordance with our Privacy Policy.
The Service operator reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. The Service operator may terminate or suspend your access immediately, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service ceases immediately.
Contactd is not affiliated with, endorsed by, or officially connected to Telegram, WhatsApp, Meta Platforms, or any of their subsidiaries or affiliates. All product names, trademarks, and registered trademarks are the property of their respective owners.
The Service operator may update these Terms from time to time. Material changes will be communicated via the Platform interface or by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service operator regarding the use of the Service and supersede all prior agreements and understandings.
